MANUFACTURERS WARRANTY Cusco Fabricators, Inc. (“Wastequip Cusco”) warrants equipment of its own manufacture to be free from defects in materials and workmanship under normal use and service, to the original purchaser only, subject to the conditions outlines below. Wastequip Cusco obligation under the warranty is limited to repair or replacement, with a similar genuine part, of any part of the product of its manufacture which is returned to Wastequip Cusco within ten days after the discovery of the defect, properly identified and transportation charges prepaid, and not more than 12 months after the equipment has been delivered to the original user. No freight, travel cost, meals or lodging shall be covered by this warranty. No warranty credit will be issued for labor or parts until such parts are returned using proper authorization tags and numbers to Wastequip Cusco for our inspection.

1.1 12 MONTH WARRANTY SCHEDULE
Wastequip Cusco will furnish without charge, F.O.B. its plant, a similar genuine part to replace any part of product of its’ manufacturer which proves to be defective in normal use and service during the period. Labor charges to install such parts will be allowed in accordance with scheduled allowable labor rates or flat rate, authorized by Wastequip Cusco prior to performance of said labor. This warranty does not apply to normal operating adjustments such as, adjusting pressure settings, limit switches, timer, relays, fuses or loss of hydraulic oil, or filter replacement. Hoist pumps and PTO’s are subject to the warranty limitations set by the pump and PTO manufacturer only. Travel time is limited to (2) two hours maximum per service call.

A) This warranty shall not apply to any failure or damage incurred through neglect, lack of maintenance, misuse, accidents, improper installation, re-designing of assemblies or through any
other cause beyond the control of Wastequip Cusco.
B) This warranty shall not apply if the equipment has been loaded above the factory recommended
maximum load capacity.
C) This warranty shall be expressly limited to the repair or replacement of defective parts, as stated
above, all other damage and claims, statutory or otherwise, being hereby waived by the
purchaser and only those labor charges specifically authorized by Wastequip Cusco. Wastequip
Cusco limits its warranty to parts and accessories supplied by it and installed in compliance with
the prevailing industry standard.

REPLACEMENT PARTS WARRANTY:
Replacement parts that Wastequip Cusco has provided due to defects in the original parts are warranted for ninety (90) days from delivery, or for the balance of the original warranty on the complete system. No labor, freight, or any other charges are covered. If the replacement part fails within ninety (90) days from the delivery date, it must be returned to Wastequip Cusco, freight prepaid, for inspection and an equivalent replacement part will be supplied.

Wastequip Cusco manufacturers and replacement parts warranties are expressly in lieu of all other
warranties. Wastequip Cusco provides no other warranties except as stated therein. WASTEQUIP
CUSCO MAKES NO EXPRESS OR IMPLIED WARRANTY AS TO THE MERCHANT ABILITY OF THE
EQUIPMENT OR ITS FITNESS FOR A PARTICULAR PURPOSE. If any sample or model was shown to
or provided by Buyer, such sample or model was used merely to illustrate the general type and quality of the Goods and such use is not to be construed as warranty that the Goods will conform to the sample or model. Any descriptions or illustrations contained in Wastequip Cusco catalogues, price lists or other advertising matter are intended merely to present a general description of the Goods and shall not form a part of this order. Wastequip Cusco makes no warranty that Buyer holds or will hold the Good free of the claim of any third person that may arise from alleged patent or trademark infringement. Since conditions of use over which Wastequip Cusco has no control may have a significant effect on the Goods, Wastequip Cusco disclaims any warranty that the Goods will conform to the standards and requirement set forth in the “Occupational Safety and Health Act” as amended or the rules and regulations thereunder. In no event is any affirmation, representation or warranty relating to the Goods applicable to any one other Buyer and no purchases from Buyer is entitled to rely thereon. Wastequip Cusco neither assumes nor authorizes any other person to assume for it any other liability in connection with the sale of its equipment.
